This is a clear cut example of a company, and now after this personal apology letter, an individual, taking advantage of the trust the gaming community has in the people they feel inclined to do business with. Shane clearly felt that the turnout for this event would be enough to cover the guarantees. He gambled and lost. We at EVB recognized that the event would struggle to make decent numbers and declined to send out our players to attend. We did have questions about the guarantee, and those have been clearly answered.

Shane if you are on here looking for forgiveness from the FGC you are in the wrong place. For you to give a half apology by pointing the fingers at the sponsors that were supposed to ensure the guarantee discredits each and every word that you typed. We do not care to hear your excuses as to why you, as an operator, failed to secure the funds from the companies that you were doing business with. You had sole responsibility to protect your entrants and you failed to do that through your lack of due diligence.

We appreciate that you spent money to give VIP treatment to many professional players. However, these funds are now viewed as a misappropriation of funds being that the winners will not be paid. The thousands used for travel, boarding and entry fees could have be used to make good on your failed guarantees. How many players entry fees went towards Flights and hotels for your VIP's?

Shane you are precisely the reason that EVB was established. To ensure that the players, who are the heart and soul of any gaming community, are protected and given the proceeds they deserve for working tirelessly to become the best at what they love to do.

If you are looking to make good with the community, then find a way to pay the funds that you guaranteed to pay. Until that time, you may want to lay low and not ask to be welcomed back to the FGC with open arms.

I know it is like that in the construction contracting business at least. Once a company declares bankruptcy even if they owe you thousands good luck ever getting the money. In my experience Bankruptcy tends to more or less absolve one of financial obligations prior to it taking place. I've seen instances where items with Leans put on them were sold and the money legally given out in order of the Lean. However in this instance it does not seem likely any further dividends will be paid out.

Depends on what kind of bankruptcy. From what I understand, Shane has tapped virtually everything he has, filing for his company and himself personally. I suppose, hypothetically, if a court battle ensues and the plaintiffs win, an execution (not literally) could be ordered. In this case, basically anything the defendant has left can be used to pay: house, car etc etc. Despite blundering on an astronomical level, a intentional tort case is unlikely given that I don't think Shane ever intended for this situation to happen. A misappropriation of funds is obvious, but everything is obvious in hindsight.
The black letter law for a civil case like this, most likely negligence, would be
1. The defendant is owed a duty of care
2. The plaintiff breached that duty
3. It was the proximate cause of plaintiff's injury (doesn't have to be physical)
4. Plaintiff suffers an injury protected under law
He was supposed to pay, he didn't pay, and the people that flew or drove out to take their time to compete suffered an injustice for it. Surrounding circumstances and the defendants knowledge must be taken into consideration and given that the organization has virtually paid entirely to the point of bankruptcy for their blunder, this was unintentional and Shane paid the price. Getting the pay out in this situation seems very unlikely. Is that justice? Well he owes people money but I doubt anyone will see it. If the man is in as dire straits as it sounds like he's in, disregarding the sob story of "I just wanted the FGC to be a better place", you could try to take legal action but I think it would just be a waste of everyone's time.

TLDR: You can sue but I doubt anything will come of it except headaches for everyone.

On a more personal note, I think the "community will see this as a learning experience, and not let it fester and affect the community as a whole negatively." comments are a little out of line, given that you're the one who is at fault and needs to pay people money they are entitled to. I'm sorry, it's really shitty that people are making death threats against you but I'd definitely try to work personally with everyone who was negatively affected by your "trust" of Verizon so you can really apologize for this.

Edit: Now I'm kinda pissed. Yes! Everyone one is owed everything. Yes! Every precautions to ensure the 'community' was taken care of was not taken. Yes! It's a galactic fuck-up. No! This does not mean burn the man. At the end of the day at least 'something' was paid out. Motherfuckers can't be happy with the fact that at the end of the fucking day you've got the time, energy, and cash to buy some fucking doritos, as wonderful as they are, and this man has given EVERYTHING to try and save even a FRACTION of the situation. Communication is key and may not be up to standard and I hope Shane talks to these players directly and come to an agreement. If he however doesn't not talk to the players, who are number 1 always, then something needs to happen. But don't Jesus the guy bruh's and bruhetes. Think of the kids.

It's business and money. Players spent hundreds (just hundreds) to attend and have a GOOD TIME. Someone won, but didn't receive money. Boo hoo, I'm sure it was a good time but people seriously want to see this man homeless because of it.

Well said, especially since he's already there, if he is bankrupted the consequences have already been dealt for his fuck up. You may as well try to hold on to what shred of humanity you have left in regards to the matter rather than making futile attempts to press legal action against a man who has literally been bankrupted by this lol. You might just have to let that $50 entry fee slid bruh.

I just want to know, losing his business and being forced into bankruptcy because of a bad business venture isn't consequence enough? He has to be taken to court and possibly lose a lot more because he tried to help?
Oh and in no way will it, I enjoy the debate and discussions on topics like this - it's how we can grow.

Ill say this, I was in a situation where I took someone to court and won. They didnt have the funds that were awarded to me in 2006, to prevent bankruptcy in agreement w the courts my lawyer and I pushed for an "allowance" to be paid until full sum was paid out.

This young man accepted this to avoid bankruptcy and I was paid over the course of two years in monthly installments. After 2008 passed I had received full payment from the defendant and he was saved from bankruptcy completely.

I suggest this route be carried out by all parties involved legally

You're right, that's why 50 Cent filed bankruptcy to avoid paying Rick Ross' baby mama, despite clearly not being broke.

i feel beyond confident that Wound, Sonic, King and Slayer are not sending the death threats nor do I think the top 3 of all other games are. i think the ones sending him that trash is garbage assholes from reddit/4chan/the dumpster fire of the internet world type people.

I have heard conflicting stories about when he knew Verizon wasnt paying so Im more inclined to take others at their word on that matter than EGLShane. Im pretty good at sniffing bullshit and him claiming he didnt know prior to that day stinks beyond rotten nuts.

Only thing I hope happens is thru his new line of work he pursues he is able to go the route I went through on the opposite end of things making a wrong a right

Apologies on the internet are easy to type attempts for a way out where as true action is the real act of an apology.

You can google a persons record I know for where I live you just google Maryland case search and its a website where you put someone name in and it shows you everyone in Maryland with that names record
